Welcome to Incentives2Quit (the “App”). By downloading, installing, and using the App, you agree to comply with and be bound by these Terms of Agreement and Privacy Policy (collectively, the “Agreement”).


Please read this Agreement carefully. If you do not agree with any part of this Agreement, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read this statement and agree to the terms listed below. You may not use the App if you do not agree to the terms.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you confirm that you are legally eligible to participate.

3. Confirmation of Crisis Line

Sometimes people have thoughts about wanting to harm themselves or ending their life. If you’re having any of these thoughts or feelings, please talk with a family member or friend. Also feel free to call or text 988, even if you just want to talk. In case of emergency, please contact 911 or go to your local emergency room.

4. Risk of Data Breach

When messaging your coach in the app, please avoid use of names or other information that might allow someone to determine who you or others are to further protect your privacy.

5. My Trends Risk Statement

This app has a feature that allows you to view graphs of the data you have provided in your check-ins. This will include health and wellness information such as smoking status, mood, and stress. If you are concerned about the possibility of other individuals seeing these graphs, please take precautions such as viewing the graphs in a private place and keeping a password on your device.

6. Incentives and Payments

The App provides monetary incentives to encourage smoking cessation. By using the App, you agree that:

  • You will accurately report your smoking status.
  • Payments of incentives are subject to verification of your smoking cessation using connected devices.
  • Incentive payments will be made according to the program’s criteria.
  • Incentives2Quit may withhold or cancel incentives if there is evidence of fraudulent activity or false reporting.

7. Data Collection and Privacy

We take your privacy seriously. By using the App, you consent to the collection, use, and disclosure of your data as described in this Privacy Policy:

a. Information We Collect

  • Personal Information: Name, email, and contact details.
  • Health Information: Smoking status and data from connected devices (i.e., breath monitor).
  • Device Information: Information about the device you use to access the App.
  • Usage Data: Interaction and session data when using the App.

b. How We Use Your Information

  • Manage the smoking cessation program and track your progress.
  • Verify eligibility and process incentive payments.
  • Provide personalized support and feedback.
  • Improve the functionality of the App through analytics.

c. How We Share Your Information

Your data may be shared with:

  • Service Providers: Authorized personnel who assist in program operations, such as payment processors or analytics providers.
  • Legal Authorities: If required by law. We may be required to share your information with the appropriate authorities if we learn about any plans to harm yourself or others and/or learn about any abuse or neglect of children or vulnerable adults.

d. Data Security

We implement commercially reasonable measures to safeguard your information but cannot guarantee absolute security.

e. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required by law.

8. User Conduct

You agree not to:

  • Falsify or misrepresent your smoking status for financial gain.
  • Use the App in any manner that violates applicable laws or regulations.
  • Distribute harmful or malicious code through the App.

Incentives2Quit reserves the right to terminate your access if you engage in fraudulent or harmful behavior.

10. Termination

We reserve the right to terminate your access to the App at any time, for any reason, including violation of this Agreement.

11. Limitation of Liability

To the maximum extent permitted by law, Incentives2Quit, its officers, directors, employees, and agents will not be liable for any damages arising from your use of the App, including but not limited to the loss of data or unauthorized access to your account.

12. Changes to this Agreement

We may modify this Agreement at any time. Changes will be effective immediately upon posting within the App. Your continued use of the App after any changes constitutes your acceptance of the updated Agreement.

13. Governing Law

This Agreement is governed by the laws of [Your Jurisdiction]. Any disputes related to this Agreement will be subject to binding arbitration or handled in the courts of [Your Jurisdiction].
